The Central Consumer Protection Authority (CCPA), an entity under the Union Consumer Affairs Ministry, has issued notices to Amazon India over the alleged sale of sweets on its platform under the name "Shri Ram Mandir Ayodhya Prasad." This move comes in response to a complaint filed by the Confederation of All India Traders (CAIT), accusing Amazon of deceptive trade practices by marketing sweets as offerings from the Ram Temple.
Rohit Kumar Singh, Chief Commissioner of the CCPA and Union Consumer Affairs Secretary, scrutinized the complaint and noted that Amazon is offering various sweets or food products for sale, claiming to be prasad from the Ayodhya Ram Temple. The Ministry, in a statement, highlighted the concern that selling food products online with false representations misguides consumers about the genuine nature of the product. This, in turn, may lead consumers to make purchasing decisions they might not have made if accurate product attributes were disclosed.
To address this issue, the Centre has invoked Rule 4(3) of the Consumer Protection (e-commerce) Rules, 2020, which prohibits any e-commerce entity from adopting unfair trade practices. According to Section 2(28) of the Consumer Protection Act, 2019, a "misleading advertisement" is one that falsely describes a product or service, gives a false guarantee, or is likely to mislead consumers about the nature, substance, quantity, or quality of the product or service.
The CCPA has requested a response from Amazon within seven days from the issuance of the notice. Failure to comply may result in necessary action being initiated against the company under the provisions of the Consumer Protection Act, 2019. This regulatory move underscores the importance of transparency in online product representations and the prevention of deceptive practices in e-commerce.
